AI Tool Data Privacy Disclaimer

This artificial intelligence tool (the “AI Tool”) has been developed by Jazze Jervis and may be provided as part of a program, course, product, service, bonus, resource, membership, or other offering.

The AI Tool operates through a third-party artificial intelligence platform and is subject to Jazze Jervis’s direction, design, and oversight. Jazze Jervis exercises professional judgment in the design and development of the AI Tool, including its knowledge base, instructions, conversation structure, frameworks, methodologies, and intended outputs.

The AI Tool may collect or process information that you voluntarily provide during your interaction with it. Depending on the nature and purpose of the particular AI Tool, this may include information about you, your business, work, clients, ideas, experiences, goals, challenges, content, or other personal or professional context.

Jazze Jervis takes reasonable steps to protect confidential and personally identifying information submitted through the AI Tool and intends to operate the AI Tool in a manner that supports confidentiality and data security. Jazze Jervis does not sell your confidential or personally identifying information submitted through the AI Tool.

However, you acknowledge and agree that the AI Tool operates through one or more third-party artificial intelligence or technology platforms. Jazze Jervis does not control the security, privacy practices, data processing, storage, or technical infrastructure of those third-party platforms and therefore cannot guarantee the security or confidentiality of information once it has been transmitted outside of her direct control.

Accordingly, you should not submit information through the AI Tool that you would not be comfortable transmitting through a third-party technology platform.

This includes, without limitation, passwords, financial account information, payment card details, government identification numbers, protected health information, confidential client records, legally privileged information, proprietary third-party information, or other highly sensitive personal, financial, medical, legal, business, or confidential data.

By using the AI Tool, you acknowledge and accept the inherent privacy and security risks associated with transmitting information through third-party artificial intelligence platforms.

Restrictions on Use of the AI Tool

You understand and acknowledge that the AI Tool, including its underlying knowledge base, instructions, prompts, conversation structure, curriculum, methodologies, frameworks, processes, examples, voice design, output architecture, supporting materials, and other proprietary components (collectively, the “AI Tool Materials”), has been developed by Jazze Jervis through the investment of significant time, expertise, effort, and expense.

The AI Tool Materials are valuable, proprietary, special, and unique assets of Jazze Jervis and are protected from unauthorised use, reproduction, disclosure, distribution, or exploitation.

You expressly agree that you will not use the AI Tool Materials in any manner contrary to these terms.

You are expressly prohibited from inputting, uploading, submitting, copying, reproducing, or otherwise providing any AI Tool Materials to train, fine-tune, develop, improve, benchmark, instruct, or otherwise contribute to any artificial intelligence system, machine learning system, large language model (LLM), automated content generation technology, custom AI tool, chatbot, agent, assistant, or substantially similar technology, whether existing now or developed in the future, without Jazze Jervis’s prior written permission.

You must not attempt to access, extract, reveal, reproduce, reverse engineer, reconstruct, replicate, summarise, or obtain the AI Tool’s underlying system instructions, prompts, knowledge base, methodologies, protected frameworks, internal logic, conversation architecture, or other proprietary components.

You may use outputs generated specifically for you through the AI Tool for the personal or business purposes for which the particular AI Tool is intended, including implementing, adapting, editing, publishing, or otherwise using your own generated outputs in your business where applicable.

However, permission to use your individual outputs does not grant you any ownership interest in, or licence to reproduce, teach, distribute, commercialise, replicate, reverse engineer, or create derivative works from, the underlying AI Tool Materials.

You may not use the AI Tool Materials, whether alone or together with your generated outputs, to build, replicate, develop, market, license, sell, distribute, teach, or provide any tool, program, course, framework, methodology, resource, service, or other commercial offering that substantially reproduces, derives from, or is designed to replicate the proprietary structure, methodology, functionality, or intellectual property of the AI Tool.

You may not train, instruct, or assist any other person or business to reproduce or create the same or a substantially similar AI Tool using the AI Tool Materials.

You may not duplicate, share, distribute, publish, sell, licence, sublicense, or create derivative works from the AI Tool Materials except with Jazze Jervis’s express written permission.

You acknowledge that unauthorised use or disclosure of the AI Tool Materials may cause immediate and irreparable harm to Jazze Jervis for which monetary damages alone may be insufficient. Accordingly, Jazze Jervis reserves the right to seek injunctive or equitable relief, in addition to any other rights or remedies available under applicable law.

All right, title, and interest in the AI Tool Materials remain the intellectual property of Jazze Jervis unless expressly assigned otherwise in writing.

Your access to or use of an AI Tool does not transfer ownership of the AI Tool Materials or grant any rights beyond those expressly provided in these terms.

If you breach these restrictions, Jazze Jervis reserves the right to terminate your access to the relevant AI Tool and, where applicable, any associated program, course, product, membership, resource, or service, subject to any rights you may have under applicable consumer law.
